Trade

Hardwicke has considerable expertise in all areas of international and domestic trade and our members are recommended in the principal legal directories.

Almost all members of our Commercial Division act and advise in relation to disputes arising from domestic sale and supply contracts as part of their core practices, including: issues relating to the construction of contracts, rejection of goods, retention of title clauses, factoring, forfeiting, and the effects of insolvency arise regularly. Our barristers have particular expertise in relation to distribution, commercial agency and franchising agreements. Members are also experienced with trade finance and letters of credit, documentary credits and performance bonds.

Hardwicke also has specialist expertise in the area of international trade, providing advice and representation in relation to every aspect of transactions. This work includes the sale, import and export of physical commodities on standard forms and bespoke contracts (cif, fob, and all other types, including incoterms). It also involves advising on futures and derivatives, including contracts on ISDA forms.

Much of this work is conducted in the Commercial Court and in arbitration, including specialist arbitral tribunals (LCIA, LME, GAFTA, FOSFA, etc). Conflict of laws issues arise frequently in international cases. Freezing injunctions and other interim measures are a regular feature of both domestic and international trade practice.
