Nigel Jones KC and Oliver Hyams act for the successful claimant, Floreat Investment Management Ltd (“FIML”), in a hard-fought claim in the Commercial Court.

FIML was the assignee of an investment fund, which had made a substantial loan to Reading Football Club. FIML succeeded in its claim that the first to third defendants had diverted and misappropriated part of the termination fee which was contractually due to the investment fund.

In a judgment handed down on 18 February 2022, Mr Justice Robin Knowles CBE found that those defendants were liable for breach of fiduciary duty, conspiracy, and dishonest assistance, that the first to fourth defendants were liable for knowing receipt, and that the defendants held the diverted sum or its traceable proceeds as constructive trustees.

David Lewis KC has been instructed in the leader’s role to deal with consequential matters as Nigel Jones QC is away on a three-month trial in Gibraltar.
