Hardwicke’s Charles Bagot acts in multi-million pound brain injury litigation

Charles Bagot represented the Claimant in HB (a protected party) v. Harmshaw (2010) QBD, Sweeney J, 17 February [to be reported], a brain injury case pleaded at more than £10 million.
Charles acted on behalf of the school girl Claimant who sustained a catastrophic brain injury when she was knocked down by a car. The particular effect of the brain injury was to make the Claimant sexually disinhibited leading to a pregnancy within two years of this accident, whilst 14 years old. She developed a virus during her pregnancy resulting in her baby being born with catastrophic disabilities. Both the Claimant and her child need 24 hour care. Liability was disputed throughout.
Charles represented the Claimant for 3 years culminating in a hearing in the High Court, on 17.2.10, when Mr Justice Sweeney approved a settlement reached for the payment of a six-figure lump sum plus periodical payments for the Claimant's lifetime.
