Human Rights & Civil Liberties
The Human Rights Act 1998 gives individuals and companies an important weapon for challenging the decisions of public bodies and tribunals, using the European Convention on Human Rights, and seeking damages for breach of public law obligations.
Issues under Articles 2-12 and 14 of the Convention may arise in a great range of public law contexts, including adoption, child protection, community care, medical treatment decisions, mental capacity, protection of privacy, and the rights of detainees. The effective representation of clients before inquests and inquiries, and regulatory tribunals, often includes human rights points.
Additional rights, such as the protection of property and the right to education (Articles 1 and 2 of the 1st Protocol), also feature in our work.
Our barristers have been praised by clients and colleagues for their skill, speed of response and ability to “think beyond the confines of existing law”. We can also offer expertise in presenting complaints before the European Court of Human Rights in Strasbourg, and other international tribunals.
