It is anticipated that multipliers will increase to reflect new data on life expectancy. This seminar will include a comprehensive analysis of the new Tables by Colm Nugent, who appeared in one of the handful of High Court cases considering the application of the Ogden Six Tables. Hardwicke invites you to this topical seminar examining not only Fibromyalgia and Chronic Pain but also recent developments relating to the Ogden Tables and hints and tips for representing Claimants and Defendants in injury claims where fraud or exaggeration is alleged.

The keynote speaker will be Dr Beverly Collett MBBS, FRCA, FFPMRCA, Associate Medical Director and Consultant in Pain Medicine member of the Faculty of Pain Medicine: Board member. Also speaking will be Hardwicke barristers Colm Nugent and Charles Bagot. The seminar will be chaired by Dr Michael Powers QC.

This seminar includes:

A unique opportunity to hear Dr Beverly Collet, a highly authoritative practitioner, medico-legal expert and experienced speaker. She will speak on the legally controversial areas of Fibromyalgia and Chronic Pain including:

  • What they are and how can we understand these conditions better;
  • Gauging and predicting the level of disability;
  • Treatment options available and the difference they might make;
  • Differentiating between the genuine and non-genuine Claimants;
  • How the medical expert can identify the causative factors and those unrelated to the accident.

 There will be time for questions from the floor and on a one-to-one basis.

Making and defending allegations of fraud and exaggeration in injury claims with Charles Bagot (Hardwicke), recommended in the Legal 500 and Chambers UK.

Practical hints and tips for those representing Defendants and Claimants in claims involving such allegations including:

  • Latest developments – Summers v. Fairclough Homes going to the Supreme Court in 2012: will fraudulent Claimants see their entire claim (including the genuine part) struck out?
  • Practical advice (for Defendants and Claimants) on when to fight and when to settle in such cases and how to go about it;
  • The use and abuse of surveillance evidence: latest guidance and advice;
  • Prosecutions for contempt.

With the imminent publication of the Ogden Tables 7th Edition and the revised guidance, this lecture looks to the legal landscape after Conner v Bradman, the other leading cases and how has the Court’s approach to Ogden 6 developed. This lecture will include: 

  • An update on current judicial approaches to future loss in light of Ogden 6;
  • Looking forward to Ogden 7 and how this may change the Court’s approach to the assessment of loss;
  • Key tactical considerations in advancing or defending an Ogden 6/7 future loss claim.
