Hardwicke's Jef Thomson and Charles Bagot examine the common law response to fraudulent and exaggerated claims in the insurance context, touching on inflated claims, figures put forward 'for negotiation', and fraudulent devices. The seminar will also cover dealing with fraudulent and exaggerated claims brought by third party Claimant's against assured's with liability insurance: are such Claimant's better off than fraudulent assured's? Can the whole or part of such a claim be struck out and if so when? We will touch upon the potential use of contempt of court proceedings as a response to fraudulent claims.
