Conflict Policy
Hardwicke has many specialist barristers who are in high demand and are specifically sought out by clients for particular cases. As a result our barristers are often instructed on both sides of a case. There is nothing unusual in this and it happens to some extent in all chambers with specialist counsel.
Barristers are individual self-employed professionals. They are not permitted to operate as a partnership or firm (unlike solicitors) and are subject to the “cab-rank” rule. They have worked their whole professional lives in this way and there is always healthy internal competition and they ensure that each client’s interests are robustly and professionally promoted.
Hardwicke has experienced practice management teams and has developed effective systems to ensure that each client’s confidentiality remains secure throughout the case. These systems are flexible and adapted for different cases (for example depending on how many barristers are involved).
