Sale and rent-back: In repossession proceedings, do mortgage lenders or occupiers have priority?
On 24 January the Court of Appeal ruled in four test cases concerning sale and rent-back transactions (when the home-owner sells a home to a purchaser who rents it back to the former owner). Daniel Gatty, of Hardwicke, acted for the Respondents in all the appeals.
A client had an acquired brain injury and was sectioned under the Mental Health Act 1983. On discharge, his local authority became his guardian for the purpose of deciding where he should live. However, it also subjected him to a deprivation of liberty at the home where it placed him.
