Hardwicke barristers are regularly instructed in child care and adoption proceedings across all court levels. They act for Parents, Children’s Guardians, Relatives, Interveners, Local Authorities and the Official Solicitor.
Our barristers have extensive experience across the entire spectrum of care and adoption work including applications for care and supervision orders; adoption and placement orders; special guardianship orders; contact with children in care; and secure accommodation. We also have expertise in wardship and other applications under the Inherent Jurisdiction of the High Court.
Our work has involved cases of non-accidental injury, neglect, sexual abuse (including internet exposure), and allegations of fabricated or induced illness. Our barristers have experience of proceedings where the families involved have mental health problems, learning disabilities, substance misuse issues and where there are complicating immigration factors. We can also advise on potential negligence aspects of failure to act in cases where a child is at risk of serious harm.
These difficult and sensitive cases often involve complex procedural and evidential issues, as well as human rights arguments. Our barristers have wide experience in both recommending experts and cross-examining experts of all disciplines. We recognise the importance to our clients in maintaining consistency of representation throughout the often lengthy and invariably difficult court process, and we aim to ensure that this is achieved wherever possible.
