Introduction and Contact details

Alexander joined Hardwicke as a tenant in October 2011 after completing pupillage.  He practices primarily in public law and insurance work.  He was called to the Bar in 2010 after an academic background in the UK and in France and has marshalled for a circuit judge, a High Court judge and the Judicial Committee of the House of Lords.

Since joining Hardwicke Alexander has been involved with a wide range of paper and court work, working in cases in the County Court, in tribunals, in the High Court and the Court of Appeal, including a number of reported cases.  He is now developing a broad practice in areas of Chambers’ expertise.

Public Law

Alexander has experience of a wide range of work in Public and Administrative Law, including advisory and court work.

Court of Protection & Mental Capacity

Alexander has been involved with cases brought on behalf of individuals, local authorities and the Official Solicitor involving vulnerable adults before the Court of Protection.  These have included cases on deprivation of liberty including before the Court of Appeal.

He has advised on the interplay between the Mental Health Act 1983 and the Mental Capacity Act 2005 and has assisted in cases concerning guardianship and compulsory detention.

Education

Alexander has advised in cases before the SENDIST (Special Educational Needs and Disability Tribunal), the First Tier Tribunal and the Upper Tribunal and regularly appears in the First Tier Tribunal.  He has been involved in cases on behalf of local authorities and schools as well as parents.  He has assisted in cases involving school admissions as well as school exclusion appeals and has written on the effect of the Equality Act 2010 on Education Law.

Judicial Review

Having an academic background in public law, Alexander has assisted in judicial review cases in the High Court including a number of reported cases.

Benefits & Social Welfare

Alexander has assisted in advising on benefits and social welfare and has appeared before the First Tier Tribunal (Social Security and Child Support) on behalf of the Free Representation Unit.

Procurement

During pupillage, Alexander was heavily involved in a large number of judicial review cases involving public procurement and in litigation involving public contract regulation.  In particular he was involved in advising, drafting and assisting with the litigation arising from the Legal Services Commission’s civil tender round, which involved litigation before the Administrative Court as well as the Chancery Division of the High Court.  These have involved considering a wide range of EU jurisprudence on the subject and have included two reported cases:

  • R(Allan Rutherford) v LSC [2010] EWHC 3068 (Admin), which dealt with the issue of delay and time limits in judicial review proceedings, as well as whether the statutory remedy in the Public Contracts Regulations 2006 provides an exclusive remedy in public procurement proceedings;
  • R(JR Jones) v LSC [2010] EWHC 3671 (Ch), which involved hearings both in the Administrative Division of the High Court as well as the Chancery Division and involved the question of mistakes made by bidders in public procurement tenders and the extent of a procuring entity’s margin of discretion under the 2006 Regulations.

 

Commercial

Alexander has been involved in advising on professional negligence work and has also assisted in employment litigation.

Employment

Alexander has assisted in cases before both the Employment Tribunal and the Employment Appeals Tribunal including cases involving allegations of unfair dismissal and race discrimination.

Professional Negligence

Alexander has been involved in advising in cases of professional negligence, in particular in cases involving negligence by solicitors, including cases of missed limitation.

Insurance

During pupillage, Alexander spent a considerable period of time specialising in insurance work, in particular personal injury.  He has been involved in advisory work, drafting and litigation before the County Court and the High Court and is regularly instructed to appear in the County Court in insurance work.

Employers’ Liability

Alexander has been involved in cases brought under health and safety legislation against employers and is familiar with the statutory and regulatory framework which can be brought to play cases of employers’ liability.

Occupiers’ Liability

Alexander has worked on cases involving breaches of the Occupiers’ Liability Act 1957 and the Occupiers’ Liability Act 1984.  He has assisted in advising and drafting pleadings in cases involving employers (where matters of occupiers’ liability frequently come into play) as well as outside the employment context.

Personal Injury

Alexander has been involved in a large number of personal injury cases, including fatal accidents.  He has experience of drafting a variety of pleadings, schedules and advices and he appears in court in personal injury matters.

Public Liability

Alexander has worked on cases brought against public authorities involving allegations of common law negligence as well as breaches of statutory duties.  He has particular experience of cases brought under the Highway Act 1980 and is familiar with the causes of action and defences which arise in that context.

Road Traffic

Alexander is very regularly instructed to appear in the County Courts in road traffic cases.  He has an excellent record of success in such matters.  He has advised and drafted pleadings in many road traffic cases.  He has worked on cases involving allegations of fraud and is experienced in the legal regime on making such allegations.
