Banking, Finance and Credit
Hardwicke’s commercial barristers have a broad range of experience in acting in banking, finance and credit matters. We regularly act for banks, lenders and individuals in connection with their financial arrangements.
In particular, we deal with all forms of security (including mortgages and guarantees), letters of credit, factoring agreements, mistaken payment, other disputes as to mandates, cheques and bills of exchange and negligence claims for substandard banking services and advice.
We regularly advise on different species of finance agreements and credit terms including conditional sale, hire purchase and consumer credit agreements and we are well equipped to advise on the often intricate requirements of compliance with the Consumer Credit Acts and their extensive regulations.
We also have the specialist knowledge required to provide advice in relation to the Regulation of financial services. The Financial Services and Markets Act 2000 (“FSMA”) and the FSA Handbook is a complex structure which requires clear, straightforward advice. Our barristers can give that advice and we have experience of acting for the Financial Ombudsman Service, IFAs and customers alike.
