Commercial Property Law Update at The Law Society

Property Damage and the Emergence of "Proximate Nuisance"

Andrew Skelly and Andy Creer from Hardwicke look at the far-reaching consequences of having Japanese Knotweed (JKW) on your land. They look at liability for property damage from natural causes and considers the first decision in England & Wales to deal with JKW. It's an interesting seminar for residential and commercial conveyancers and anyone with developer clients.

Vacant Possession

Where does the law currently stand on the commonly used, but often misunderstood, phrase of "vacant possession"? How vacant does a property need to be in order to comply with an obligation to give up vacant possession? The answer is more complicated than it might at first seem and is a question which is particularly relevant when exercising break clauses in leases as well as when selling land.

Robert Phillips, Partner at Hugh James, will look at recent case law on this subject, particularly in the context of the servce of break notices to terminate commercial leases.

We will also briefly cover issues that arise for property lawyers in dealing with construction documentation.
