Hardwicke Building’s John Friel has recently acted in a dispute involving the Norfolk Primary Care Trust. John represented Bill and Jean Butt in a case concerning their daughter Tracey, who has cerebral palsy and epilepsy, and faced the prospect of being relocated from her NHS residential home. The couple were informed, without any prior consultation, that the local NHS Trust was to close the home and residents were to be moved to homes within the community. John took the case to the High Court where it was established that the Government White Paper ‘did not create a mandatory duty,’ to close the home.
